 *COURT THROWS OUT FUNDAMENTAL RIGHTS CASE AGAINST EX-GOVERNOR IMO OHAKIM, INSPECTOR GENERAL OF POLICE, OTHERS.*

A High Court sitting in the Federal Capital Territory has dismissed a fundamental rights case brought against former Imo State Governor, Dr. Ikedi Ohakim, the Inspector-General of Police (IGP), and several others.


Presiding over the matter, Justice Binta Mohammed ruled that the suit, instituted by Lady Chinyere Lilian Amuchinwa, was an abuse of judicial process. The defendants also included the Police Service Commission (PSC), SP Amina Omudu, ASP Bartholomew Ali, and Mr. Chinedu Okparaeke.


The claimant had accused Ohakim and his associates of orchestrating her detention by the police at the Force Headquarters in Abuja in July 2021, although the details of the alleged offense were not disclosed in the court filing.


In response, the defendants filed a preliminary objection, asserting that the suit lacked merit and duplicated other cases previously filed by the same claimant against the same parties in various courts. These included a similar suit at the Imo State High Court in Owerri, an appeal at the Court of Appeal Owerri Division, and criminal charges before the Federal High Court, Abuja. Records showed that these earlier cases had either been dismissed or struck out.


Delivering judgment on June 26, 2025, Justice Mohammed agreed with the defendants, stating that the repeated filing of similar cases constituted a clear abuse of court processes. The court consequently ruled in favor of Dr. Ohakim, the IGP, and the other respondents, putting the matter to rest.
